The United States District Court For Western District of Texas (in the case excerpt, W.D. Tex. ) is a federal district court. The trial convened in San Antonio with divisions in Austin, Del Rio, El Paso, Midland, Pecos, and Waco. It has jurisdiction in over 50 Trans-Pecos, Permian Basin, and Hill Country states in the US state of Texas. The district covers over 92,000 square miles (240,000 km 2 ) and seven divisions.

History

The first federal judge in Texas was John C. Watrous, who was appointed May 26, 1846, and previously served as Attorney General of the Republic of Texas. He was assigned to hold a trial in Galveston, at that time, the largest city in the state. As the seat of the Texas District of Justice, the Galveston court has jurisdiction over the entire state. On 21 February 1857, the state was divided into two districts, East and West, with Judge Watrous continuing in the Eastern district. Judge Watrous and Judge Thomas H. DuVal, from the Western District of Texas, left the country on the separation of Texas from the Union, only two US Judges did not resign from their positions in the breakaway states. When Texas was returned to the Union, Watrous and DuVal resumed their duties and served until 1870.

Appeals from cases brought in the Western District of Texas were brought to the US Court of Appeals for the Fifth Circuit (except for patent claims and claims against the US government under the Tucker Act, which appealed to the Federal Circuit).

The US Attorney's Office for the Western District of Texas represents the United States in criminal and civil litigation in court. The office is currently occupied by Richard Durbin who became US Attorney after Robert L. Pitman, a former US Attorney resigned to take a seat on the federal bench after receiving his judicial commission on December 19, 2014. Pitman previously served as an interim United State Attorney for the district on in 2001, before becoming deputy head to Johnny Sutton.

Chief Justice

The Chief Judge has administrative responsibility for their district court. Unlike the Supreme Court, in which one justice is specifically nominated for head, the office of the chief judge revolves among district court judges. To be a chief, a judge must have been active in court for at least a year, under 65, and has never served as a chief judge. Vacancies are filled by the highest judges in seniority among eligible judges. The presiding judge shall be valid for a period of seven years or until the age of 70, whichever occurs first. Age restrictions are waived if no court member will qualify for that position.

When the office was founded in 1948, the chief judge was the longest serving judge who did not choose to retire on what has been known since 1958 as a senior status or refused to serve as a chief judge. After 6 August 1959, the judge could not become or remain head after the age of 70 years. Current rules have been in operation since October 1, 1982.
