The Australian Construction Contract governs how the parties to the construction contract behave and how the project manager and contract manager govern the relationship between the parties. There are several forms of standard construction contracts that are currently used in Australia.

Australian Contract Standard General Conditions AS2124-1992

General Provisions of Contracts for Design and Construction (AS4902)

AS4902 provides options for project procurement:

General

Liquidation Damage

Each set of contract terms contains a Time Attachment of space to include the level of damage liquidated. This rate is the initial estimate of damage that will be incurred by the owner if the project is not completed by the official date to be completed. Once accepted on contractual basis, the rate will apply whether the actual damage is higher or lower than the forecast. Accumulated damage is always counted on calendar days.

Damage Liquidation may be limited to a percentage of the contract amount. It is normal for Australian construction contractors to seek accountability by trying to introduce a limit on Liquidation Damage, usually 10% of the contract amount.
