The Australian Construction Contract governs how the parties to the construction contract behave and how the project manager and contract manager govern the relationship between the parties. There are several forms of standard construction contracts that are currently used in Australia.

The contract may allow reimbursement for the cause of the delay listed in clause L1.1 of clauses 1 through 13. This provision thereby provides a replacement to the builder even if the cause of the delay is not a breach of contract on the part of the owner. Where the delay is caused by a breach on the part of the owner, the builder is entitled to recover damages suffered and occurs.
Building Industry Contracts Australia - SW-1

The contract is similar to MW-1 but is intended to be used on building works from A $ 50,000 to A $ 3 million.

Australian Contract Standard General Conditions AS2124-1992

This Australian standard prepared by a number of scientific, industrial and government organizations is still the preferred document for many government departments. It provides either a sum of all at once or a schedule of contract tariff types and the quantity bill may or may not form part of the contract or may be part of the specification.

Produced by the Australian Property Council, this document can be seen as an alternative to ABIC MW1 and US contracts. It is suitable for Design and Construction project, as well as Construction contract only.

Variations are assessed using the rates or rates that appear in the Schedule of Cost or Quantity List of applicable prices. The percentages listed in Contract Particulars are added to the calculated value. Percentages should also be applied where a reasonable amount is approved or determined. In approving or determining a reasonable amount, no mark-up is entered

This form of contract is intended for building work (including changes) in which the contract must be managed by an architect and where payment to the builder should be based on the actual cost of the work plus the cost. This fee can be either a single sum or a percentage of the cost of the job.
General Provisions of Contracts for Design and Construction (AS4902)

Construction Management Agreement
- General
This Agreement is for use where there is no head contractor and the owner pays to the cost manager for his services. This Agreement is issued by the Royal Institute of Architects (Victorian Chapter).

Liquidation Damage
Each set of contract terms contains a Time Attachment of space to include the level of damage liquidated. This rate is the initial estimate of damage that will be incurred by the owner if the project is not completed by the official date to be completed. Once accepted on contractual basis, the rate will apply whether the actual damage is higher or lower than the forecast. Accumulated damage is always counted on calendar days.
Damage Liquidation may be limited to a percentage of the contract amount. It is normal for Australian construction contractors to seek accountability by trying to introduce a limit on Liquidation Damage, usually 10% of the contract amount.
